Terms of Use

The short version: Withkin is a private place for adults to notice and appreciate their families. Be kind, share only what you have permission to share, protect children, and report anything unsafe. These Terms explain the rules in full.

1. Accepting these Terms

By creating or using a Withkin account, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service. If these Terms materially change, we will ask you to review and accept the new version before continuing to create or share content.

2. Who may use Withkin

You must be at least 18 years old and able to enter into a binding agreement to hold a Withkin account. Adults may create and manage profiles for children in their family. Children do not receive independent accounts through those profiles.

You are responsible for your account credentials and for activity performed through your account. Use accurate information, keep your password private, and tell us promptly if you believe your account has been compromised.

3. Family spaces and invitations

Withkin spaces are invitation-only. Family administrators choose whom to invite and may manage membership. An invitation is personal to its recipient. Do not publish invitation links or use them to add people without the family’s permission.

Private does not mean risk-free. Other members can see family-wall content and may capture or repeat what they see. Share thoughtfully, especially when a post includes a child, another person, health information, or a photograph.

4. Community and content rules

Withkin is positive-only by design. You may not create, upload, send, or encourage content or behavior that:

  • harasses, humiliates, threatens, stalks, bullies, or abuses another person;
  • promotes hatred or violence based on a protected characteristic;
  • sexually exploits anyone, depicts sexual abuse, or sexualizes a minor;
  • encourages self-harm, credible violence, dangerous acts, or criminal activity;
  • shares another person’s private or identifying information without permission;
  • infringes copyright, privacy, publicity, or other legal rights;
  • impersonates someone, deceives others, distributes malware, or sends spam;
  • uses Withkin to advertise, solicit strangers, or evade a block or moderation action; or
  • otherwise violates applicable law or creates a safety risk.

Do not upload a photo or write about someone unless you have the right and appropriate permission to do so. Adults are responsible for deciding what is appropriate to share about children they manage.

5. Reports, blocking, and moderation

You can report a post and hide posts from a member using the controls in the app. Reports are sent to Withkin for review. You may also contact privacy@withkin.family for safety or moderation concerns. If someone may be in immediate danger, contact local emergency services first.

We may investigate reports; limit visibility; remove content; preserve evidence where legally required; restrict, suspend, or terminate accounts; or take no action when a report does not establish a violation. We may act without advance notice when necessary to protect a person, the service, or the law. We do not promise to monitor every private family interaction.

6. Your content

You keep ownership of content you create. You give Withkin a limited, non-exclusive, worldwide license to host, store, process, reproduce, and display that content only as needed to operate, secure, improve, and provide the service to the people you choose. This license ends when the content is deleted, except for temporary technical copies, lawful retention, or content another user created about you as described in the Privacy Policy.

You represent that you have the rights and permissions needed for content you submit and that your content and use of Withkin comply with these Terms.

7. Privacy and account deletion

Our Privacy Policy explains what data we process and how we protect it. You can start account deletion from the app or through our public deletion page. Deletion effects differ depending on whether other family members remain; the deletion flow explains those effects before confirmation.

8. Service availability and changes

Withkin is evolving. We may add, change, pause, or remove features; set reasonable limits; or stop offering the service. We will avoid holding family memories hostage: if future paid options are introduced, we will give advance notice and explain what changes. Purchases, if offered, will also be subject to the applicable app store’s terms.

We may perform maintenance or experience outages. We do not guarantee uninterrupted, error-free, or permanently available service. Keep copies of anything you cannot afford to lose.

9. Suspension and termination

You may stop using Withkin or request account deletion at any time. We may restrict or terminate access for serious or repeated violations, legal requirements, security threats, or misuse that harms other people or the service. Provisions that logically must survive termination—including ownership, licenses already needed for lawful retention, disclaimers, and limitations—will survive.

10. Disclaimers and responsibility

To the maximum extent permitted by law, Withkin is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or non-infringement. Withkin is not an emergency, medical, mental-health, legal, or child-safety service.

To the maximum extent permitted by law, Withkin and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, lost data, lost profits, or harm arising from another user’s conduct. Nothing in these Terms excludes rights or liability that applicable law does not allow us to exclude.
